What the rules actually require
GDPR does not ban transferring personal data outside the EU — it requires an adequate legal mechanism, such as standard contractual clauses, and a transfer impact assessment. The EU AI Act adds obligations around transparency and record-keeping for many AI systems. Customer contracts, especially in finance, health and the public sector, are often stricter than the law: EU-only processing is increasingly a commercial requirement, not a legal one.
Map your data flows first
List every place personal data touches an AI system: prompts, retrieved context, fine-tuning datasets, logs and analytics, and the providers' own retention. Most teams discover the prompt is the least of their problems — the forgotten telemetry pipeline sends more personal data abroad than the model ever sees.
Choose providers with EU processing options
Major model providers now offer EU data residency, zero-retention endpoints, or European deployments. Make it auditable
